3 Years with accidental damage covered.  Must purchase within 60 days of receiving unit.

1. The Agreement

This SmartEye Care+ Service Contract ("Plan") is a legal agreement between the purchaser ("You" or "Customer") and Pegasus Astro Co Ltd ("We," "Us," or "Provider"). Receipt of your payment for the Plan constitutes acceptance of these Terms and Conditions. This Plan covers the SmartEye optical device ("Covered Product") associated with the specific serial number registered at the time the unit was received.

1.1 Purchase Eligibility Window To be eligible for coverage, this Plan must be purchased within sixty (60) days of the date You received the Covered Product ("Date of Delivery"). We reserve the right to verify the Date of Delivery via carrier tracking information, delivery confirmation, or the original sales invoice. If it is determined that this Plan was purchased more than sixty (60) days after the Date of Delivery, this Agreement is void, coverage is denied, and a full refund of the Plan Price will be issued.

2. Term of Coverage

The coverage period for this Plan is three (3) years from the original date you received the unit ("Plan Term").

  • Manufacturer Warranty Alignment: This Plan runs concurrently with the standard 2-year Manufacturer’s Warranty.
  • Extension: This Plan extends mechanical and electrical breakdown coverage by one (1) additional year beyond the Manufacturer’s Warranty.
  • Accidental Coverage: Accidental Damage from Handling (ADH) coverage begins immediately on the date the unit was received and continues for the full 3-year Plan Term.

3. Coverage Details

3.1 Accidental Damage from Handling (ADH) We understand that the Covered Product is used in low-light environments where handling risks are higher. This Plan covers operational failure resulting from accidental damage during normal use, including:

  • Drops and impacts (e.g., dropping the unit while swapping optics).
  • Cracked screens or lenses resulting from impact.
  • Liquid spills or submersion.

3.2 Mechanical & Electrical Breakdown After the expiration of the Manufacturer’s Warranty, this Plan covers defects in materials and workmanship and failures due to power surges or internal mechanical malfunctions.

4. LIMIT OF LIABILITY FOR ACCIDENTAL DAMAGE

The following provisions strictly govern the limits of liability and deductibles regarding Accidental Damage from Handling (ADH).

4.1 Claim Frequency Limit Coverage for Accidental Damage from Handling (ADH) is strictly limited to one (1) approved claim per twelve (12) month period. This period is calculated as a rolling 12-month window starting from the date of the most recent approved claim.

4.2 Deductible and Service Fees Service fees for approved ADH claims are determined based on the total number of claims filed during the lifetime of the warranty (including any renewals):

  • First Claim: The first approved claim shall be processed with a $0.00 USD (Zero) deductible.
  • Subsequent Claims: Any subsequent claim approved after the first—regardless of when it occurs—shall be subject to a mandatory, non-refundable deductible of $249.00 USD.

5. Exclusions (What is Not Covered)

This Plan does not cover:

  • Cosmetic Damage: Scratches, dents, peeling, or discoloration that do not affect the functionality or performance of the Covered Product.
  • Loss or Theft: This Plan is not an insurance policy against loss or theft. If the device is lost or stolen, coverage does not apply.
  • Reckless Abuse: Damage resulting from intentional abuse, modification, or use outside of the manufacturer’s specified operating parameters.
  • Pre-existing Conditions: Damage that occurred prior to the purchase of this Plan.

6. Claims and Shipping Logic

6.1 Filing a Claim To file a claim, You must contact SmartEye Customer Support. You may be required to provide proof of purchase and photos of the damage.

6.2 Shipping Costs Shipping coverage is determined by the claim history, aligning with the deductible structure in Section 4.2:

  • First Return: For the first approved claim, We will provide a pre-paid shipping label covering the cost of shipping the device to our repair center and returning it to You.
  • Subsequent Returns: For any subsequent claims, You are responsible for all shipping and handling costs associated with sending the device to Us. We will cover the cost of return shipping to You.

7. Transferability

This Plan is non-transferable. Coverage applies only to the original purchaser and the original Covered Product. If the Covered Product is sold or given to a third party, this Plan is voided immediately. (Note: The standard Manufacturer’s Warranty may remain valid for the new owner depending on manufacturer policy, but SmartEye Care+ benefits will cease).

8. Cancellation and Refunds

8.1 30-Day Cancellation Period You may cancel this Plan for any reason within thirty (30) days of the original purchase date.

  • Refund Eligibility: If You cancel within this 30-day window and no claims have been filed, You will receive a full refund of the $499.00 USD Plan Price.
  • Effect of Claims: If a claim has been filed or approved within the first 30 days, the Plan is considered fully utilized, and no refund will be issued upon cancellation.

8.2 Post-30 Days (Final Sale) After the expiration of the 30-day Cancellation Period, this Plan becomes non-cancellable and non-refundable. No pro-rated refunds will be issued for cancellation requests made after day 30.

8.3 Termination for Cause (Provider Only) Pegasus Astro Co Ltd ("We" or "Us") reserves the right to terminate this Plan immediately in the event of fraud, material misrepresentation, or abusive behavior.

Abusive behavior includes, but is not limited to:

  • Hostile, threatening, or harassing conduct towards our employees or representatives.
  • Intentional damage to the Covered Product.
  • Unauthorized tampering, disassembly, or modification of the device hardware or firmware.
  • The filing of false or deceptively altered claims.

If We terminate the Plan for cause, no refund will be issued.
